Fisticuffs, Zoning Issue Mark New Woes for Marigny Groups



Mounting tension in the Marigny came to blows, literally, Thursday.

 

Conflict has been simmering between Marigny business owners and the neighborhood group, the Faubourg Marigny Improvement Association, over the past year. Business owners accuse the organization of targeting them with false complaints as part of a campaign to close establishments such as Mimi’s bar, and the Plan B bike project. The FMIA accuses businesses of noise violations, “open doors,” and using residentially zoned spaces for commercial purposes. The disharmony was exposed last month when an Association meeting devolved into a shouting match. Ironically, though, a showdown between the two sides was not the conflict's nexus. Instead, Thursday's boiling point took place within the walls of the Association's offices, between two members of the Association's board.

 

According to the NOPD, Association President Chris Costello and the group’s treasurer, Eva Campos, became involved in an altercation. Campos sustained minor injuries to the leg and arm before contacting the police. Just after 10 a.m., the NOPD responded to a complaint and issued summons for assault to both parties. In addition, Campos was given a trespassing citation.

 

As the tension around the neighborhood has mounted, so too has a debate mounted within the Association about how best to run the organization. The weeks of discord flared up in the midst of an accounting dispute between the two.

 

The altercation occurred at 535 Mandeville, an office shared by both the FMIA and St. Claude Main Street. In addition to being Treasurer of the neighborhood organization, Campos is also an employee of St. Claude Main St. According to their mission statement, the organization “exists to cultivate, nurture and sustain an economic revival of this historic commercial district.” Campos has worked for St. Claude Main Street for two years, during which time the office has been housed at 535 “on and off.” Campos has a key to the office, and has accessed the premises at all hours over those years.

According to Campos, Costello cited a broken foot, and asked her to speak with him in his apartment, next door to the offices. After the policy debate, Costello, the Chairman of St. Claude Main Street (in addition to the FMIA helm) asked Campos to leave the premises. Campos headed to the adjacent property to clean out her desk in the FMIA office. Campos claims Costello then trailed her into the office, and declared that he did not trust her. She then reached for the phone "to call 911," and Costello grabbed her arm, preventing use of the phone. Campos' story concludes that Costello allegedly put her in a headlock, throwing her against the wall, and then onto the floor. Campos sustained bruising on her arm, and cuts to her leg.

 

Costello did not respond to repeated requests for comment.

When police arrived on scene, they offered both parties a choice. The police explained that since it was one person's word against the other, they could act as if nothing happened or issue summons to both parties. Costello asked to ignore the problem, but Campos pushed for charges to be filed, the report said.

 

"I love the Marigny, and I am proud of the work that I have done with both the FMIA and St. Claude Main Street," Campos said. "Both organizations have done good things for the community, and I am deeply saddened that this incident occurred, and even more alarmed by the prospect that it could overshadow our good work."

 

A call to Louisiana Main Streets was returned by the Lieutenant Governor’s office. They had been briefed on the incident, but deflected any jurisdiction, claiming it was a local issue.

 

The FMIA lists their address as 2401 Burgundy. When NoDef visited the location, we found no offices, only the WhoDat Coffee Shop. The clerk said that Gretchen would be in for coffee in the morning if we wanted to leave a message. Likewise, St. Claude Main Street lists their address as 2372 St. Claude, but that address yielded only the shell of the future healing center. Instead both organizations apparently operate out of 535 Mandeville.

 

The building itself is owned by Hestia LLC, an entity registered with the state of Louisiana by John Deveney. Deveney also owns the building next door, which houses Deveney Communications. Costello also works there. Sources stated that no rent money is exchanged, but Hestia reaps tax benefits for the donated space. 

 

According to records provided by the City Planning Ofifice, 535 Mandeville is zoned Residential III.  The building (pictured) is a house, with no clear commercial intent. Such conditions would make the property ineligible for use as an office even according to the secondary provisions set forth in Section 10 of the Residential Diversity Overlay. For the last year, it has housed an organization that has prided itself on enforcing these very same violations. As recently as Monday, the FMIA released an article in their newsletter “Les Amis de Marigny” countering the validity of Mardi Gras Zone owner, Benny Naghi’s complaints, by noting that Mardi Gras Zone is zoned Residential.

This is more entertaining than previous years' BNA melees...wow, it was a long time coming but thanks FMIA. hope there is more where this comes from. ps this website is extremely biased and "reporting" is not a word i would use to describe the story, i think it's fantasy blogging.

I've lived in the Marigny or

I've lived in the Marigny or Bywater since 1999. I'm a little confused as to what it is, exactly, that the FMIA does BESIDES gun for bars and non-profit organizations. Lisa Suarez had her sites set on Plan B and the ARK building well before the storm. The only thing I've heard of them doing besides that is bitching about parking. I would love some illumination on this subject. And why are you all pointing out faults in the reporting of a fucking blog but not addressing the fact that the FMIA is breaking the exact same zoning codes that PLan B and Iron Rail got charged with. Personally, I'm completely fed up with a bunch of spoiled, snot-nosed land-owners calling the shots in my neighborhood. I pay rent, I have a job, I have tattoos, I probably get called a "gutterpunk" by delusional bourgeois assholes every day. It's been like this for 12 years and I, along with lots of other residents of this neigborhood, are over it. Fuck the FMIA.

I am a property owner in your neighborhood, and I completely agree with the commenter. Not only is the FMIA hypocritical and elitist, it does not dispense its venom even-handedly. Neighborhood businesses are the backbone of a thriving urban existence. The FMIA has no business discouraging the businesses it dislikes in favor of those it arbitrarily deems "worthy" based on its own preconceived value system. If a business doesn't serve the community's needs, it will fail. Chris costello needs to have his head examined then he should get the hell out of FMIA. He is a complete buffoon, who not only has no self-control but is complicit in beating a woman. Frankly I wouldn't be surprised, if there is a litany of other such assaults and battery on his record. That of course will all come out if this goes to court. There is a reason why he opted for the police to not file a report.

What are the thoughts of the other board members about this Eva-Chris issue? Have you asked them? I'm sure you might get an earful on Miss Eva (from what I've been told). As a reporter you may also want to check to see if she's deflecting because she's hiding wrong doing on her part. That's the first thing that came to my mind.

Can you further explain how receiving an assault at the hands of a person you are volunteering with is a deflection? It sounds to me like Chris was preventing Miss Eva from taking information which would be incriminating to him from the office when he told her to leave.

Again, if she has been stealing funds or acting inappropriately in some other way then you and the board have a duty to release that information immediately and report it to the police.

Wow - everyone really has it

Wow - everyone really has it out for Chris – Kinda disappointing this issue has declined into a personal vendetta rather than a call to support local business. Really kinda a pointed piece - I have serious doubts about this story's validity. NoDef should be real careful about getting involved in this type of dirt slinging. Could lead to somebody doing or saying something they regret. Lies and anarchy are not tactics i can endorse. I really feel strongly about the ability of businesses and residents to coexist, but this group is losing my support with these juvenile tactics.

NoDef has obviously taken a firm position on this issue and ignored the filpside of the coin. The neighborhood and preservationist perspective is a valid one and has a rich history in overcoming momentous political and corporate pressure to preserve the historical Faubourg Marigny. I for one am grateful that we do not live in a mess of t-shirt shops and big ass beer saloons. I know it is easy for businesses to say that "we are not doing that" but if you understand zoning law - you would get that one leads to the other.

Now, besides the obvious Lost Love advert sitting right next to the story, everyone knows that NoDef's staff is partial to these businesses. It sure is sad when a paper sells out it's independent voice to peer pressure and advertisers. NoDef presents a very narrow and naive view of a complex issue, but every one is free to be what they want. Personally, i turn to the independent press for a higher intelligence than the statesman, but in this case, i would have to say this story is about as amateur as the paper at my middle school. I guess being the cool webpaper is more important than being the smart webpaper.

And since when do people love the Mardi Gras Zone so much - they charge twice as much for spoiled, expired items. Benny obviously doesn't love the neighborhood. He is a carpetbagger who moved in after the storm to exploit the need for a grocery store. But rather than doing it right - he has violated several city codes to make a very large buck. People show support with their money - and i promise, as soon as the coop opens up and Roberts get their sh*t together, nobody is going to want that bug infested, rotten crap. For the past couple years, Benny has sought approval for a liquor license so he can make more money - but his shop is zoned heavy industrial and his neighbors don't want drunks hanging around the 24 store all night long. I think that is a fair position.

I really have the most confusion about Plan B in all this. They have been residing in that warehouse since way before the storm and with no issues. Now - I find it interesting that now the anarchists and capitalists have joined forces against the so-called fascist regime of Chis Costello. I guess as a reader i would want to know more about that story. Or seriously - what is the history of these businesses and why FMIA thinks they should be shut down vs. why businesses think they should stay.

In summary, while I tend to side with the rights of the businesses. I do think that the FMIA could do a better job of mediating the complaints of residents against businesses. However, I really don’t like the tactics that business groups are using to get attention.
