Marigny Meeting MeleeBusiness Owners, Iron Rail Protest Anonymous ComplaintsMARIGNY - There was a line to enter the Faubourg Marigny Improvement Association’s meeting in St. Paul Lutheran School last night. An older man asked others in the line, “What’s going on? Not many people usually attend these meetings.”
“Oh, you’ll find out,” an excited voice answered.
A cross section of business owners, young activist types, longtime homeowners and, yes, regular people, from across the Marigny had flooded the meeting to voice concerns about a spate of anonymous complaints. The complaints have been occurring throughout the neighborhood and resulting in infractions against business owners. A primary – and high profile – example of this occurred on Ash Wednesday, when NOPD shutdown operations at the ARK building, located at 511 Marigny St. The building housed the Iron Rail Book Collective, the community bike shop, Plan B, the recycled art supplies seller Hasbin Willys and numerous art studios.
A release issued by the NOPD in the wake of the shutdown singled out the Iron Rail, and said the collective's spot – which featured a lending library, zine stand, record shelf and stacks of books for sale by radical authors – did not have proper operating permits.
More was said about the shutdown for a large portion of the meeting, but what permits the Iron Rail needs remained a mystery.
Sean Walsh announced on behalf of the book collective that the organization decided to leave the building, where it operated for the last eight years. Victor Pizzaro, of Plan B, berated the powers-that-be.
“I am absolutely disgusted that a city that is so lacking in free social services will willfully and illegally shut down legal operations that are only benefiting this neighborhood, because some people don’t like the way other people look.” Tattooed hands applauded his remarks.
Police officers said they were required to investigate the anonymous complaint – which was called in to a still-anonymous city councilor’s office. After the Iron Rail and Plan B failed to produce permits of operation to the NOPD officers, who were present at the meeting, NOPD shut down the operations. Walsh claimed during the meeting that, by law, they were supposed to be allowed 2 to 10 days to produce the proper documentation. Walsh claimed the NOPD only gave them “2 to 10 minutes” to do so.
Walsh did not bring proof of permits to the meeting last night. However, neither did the NOPD bring copies of their report, which they claim exists. Some at the meeting said it does not exist. FMIA President Chris Costello told Walsh that if he could produce the permits today, then he would be “more than glad” to help the ARK "tenants" out.
“2 to 10 days,” Walsh responded.
Earlier in the meeting, FMIA President Chris Costello had invited Benny Naghi to voice concerns. As Naghi stood, someone whispered in the crowd, “Get ‘em, Benny!”
Naghi, who owns the neighborhood gathering point Mardi Gras Zone Market, demanded new elections so that the FMIA Board of Directors could more accurately represent the diversity of the neighborhood.
The crowd roared at the suggestion, mostly in approval. Somewhere in the shouting, there was the incendiary suggestion to have the new election - at that moment.
The chants that were overheard: “Let’s do it now!” “You can’t do it!” “The board decides that!” “No more secret meetings!”
“‘Secret meetings’ is ludicrous!” Costello said.
Bill Walker, one of the owners of the Lost Love Lounge, located on Franklin Ave.,requested that the FMIA, in keeping with its 501(c)(3) status as a nonprofit, release the names of its Board members, emails and other electronic records sent to or from Board members in the last year, tax records, form 990s, tax exemption documentation, and the supporting books and records of the Association.
After the meeting, a young man who wishes only to go by Frank said, “[The Board] does have their own agenda, which excludes – and maybe it's not intentional - people of color, and people on the social economic fringes.”
Flux Rostrum, who filmed the meeting, offered his own analysis:
“A lot of people were able to express themselves. But there was no moving forward. Costello deflected, deflected, deflected. The direct call for a new election was ignored. There were opportunities to solve the issues presented right there – no more yapping. But there was no desire from people running the meeting to solve the issues presented.”
Later in the evening, Costello was be overheard telling a fellow board member, “We were ambushed.” ’)

jedsdead -- im not really sure how the secret board member thing got started, clearly the board members names and email are on their website. i think the whole secret meetings, the gang of 12, and the board got juxtaposed.
that said, dont email them, come to the lost love lounge (of which i am a part owner, my name is bill walker) on april 17th and sign up to become a member of the association. then on 4/18 we can go to the general meeting, arm in arm, and voice our displeasure.
the fmia has a small cabal that has overstepped its bounds. its time to rise up and for once, actually put that old bumpersticker into play: think globally, act locally.
we can only fight for so long without your support, so come on out, join the fmia, and let them know that this is your neighborhood. your voice is as valid as anyone else, and it deserves to be heard.

The board regularly cuts points of order from it's minutes that are printed in the newsletter, does not publicize it's meeting to it's vast constituency (ie the renters in the marigny), and makes no effort to reach out to the majority of citizens that fall within their domain.
Business is suffering because of this organization and the anonymous complaints they encourage. Its our organization, not chris costellos pet. If the board doesn't like businesses and citizens of the neighborhood declaring "no confidence" in the board, they are welcome to step down.
Until then, change will be called for.

Sftsc, who is being disingenuous? Hundres of copies of the newsletter are distributed free at various coffee shops and cafes in the neighborhood, so any interested renter has access to meeting dates, locations and minutes. I think that qualifies as 'reaching out'.
As far as omiting points of order, 2 points of order: 1) per Wikipedia 'A point of order may be raised if the rules appear to have been broken. This may interrupt a speaker during debate, or anything else if the breach of the rules warrants it. The point is resolved before business continues.' If they were omitted, so what. 2) how would you know if they were omitted - were you there? I think not. I call a point of order on baseless assertion of facts.

actually faceless masses, if that is your real name, i was there. at the 2/21 fmia general meeting, when council person palmer was in attendance, i raised the point of anonymous complaints being made against the businesses of the marigny and what recourse business had.
how was my complaint addresses?? chris costello brushed it aside, and no mention of my complaint was made in the minutes of the following news letter.
how did i follow up?? well, faceless masses, my name is bill walker. i am one of the owners of the lost love lounge, and at the last meeting i called for the fmia to produce all correspondence to or from any board member so that the auxiliary at large can see exactly how the board is acting on or against our interests as business people, as members of the community, and as residents of new orleans.
i am also calling on the fmia to produce all tax records and supporting documentation.
and so what?? ill tell you so what, this seems like a ploy by the fmia to gloss over the opinion of those who disagree with the board. if it is, then its an organization that is anti business which is bad for everyone. if its not, then there are a few bad neighbors in this neighborhood that believe making false, baseless accusations is an appropriate remedy, in which case the fmia has been neutered.

1. false complaints strain already limited budgets that city and state departments have. yeah, lets make the state waste money!!! /sarcasm
2. the fmia should be a transparent organization. so lets see those records.

I completely agree with the
I completely agree with the call for FMIA to hold to the same standards as all other 501(c)(3)'s and make their documentations & board members public record. Mayor Landrieu has made it clear that transparency is to be the norm in all phases of city government; who are the FMIA to argue?
I'm very disturbed by the NOPD's reluctance to not only share their report on the incident, but their flagrant disregard for the 2 to 10 day requirements for The Ark to produce their permits. However, I cannot say that I am surprised. It was this same ignorance that allowed the Blue Nile debacle to happen. As the Department of Justice has already shown, the NOPD is not to be trusted as far as you can spit a pig.
At least they didn't show up with truncheons & tear gas to break up the meeting.

I, too, agree. Have you seen the FMIA newsletter? Apparently not, or you would know that the Board members are listed in every issue, along with an email address at which to reach them. Additionally, the minutes of every board meeting are published in the newsletter.
I'm always amazed how people can make groundless statements and be believed by others who take it all at face value.
